BANQUE RICHELIEU GCC LIMITED (“the Bank”) is registered in the ADGM with registered number 000000479, Financial Services Permission number 160022 as a private company limited by shares for the purposes of providing the following Services to Professional Clients and Market Counterparties:

i.   accepting deposits;
ii.    dealing in investments as principal;
iii.    dealing in investments as agent;
iv.   arranging credit;
v.   arranging deals in investments;
vi.    advising on investments or credit;
vii.    providing credit;
viii.    managing assets;
ix.    providing custody;
x.   arranging custody;
xi.   providing money services.

Data Subject’s Rights

Banque Richelieu GCC Limited confirms to you his continued compliance with the Data Protection Regulations 2021, including without limitation the Data Processing Principles, in respect of the protection and legitimate Processing of your Personal Data and Sensitive Personal Data within the Abu Dhabi Global Market. He also confirms that he will apply adequate safeguards as well as technical and organizational measures with respect to the protection of such Personal Data and Sensitive Personal Data against unauthorized or unlawful Processing and against accidental loss, destruction or damage, noting that your Personal Data will be used for your banking activity.

Banque Richelieu GCC Limited confirms your right to request and obtain without undue delay the rectification of an inaccurate Personal Data, as well as the right to require and obtain from the Bank confirmation as to whether or not Personal Data relating to you is being Processed and where that is the case access to the Personal Data and the following information: a) the purposes of the Processing b) the categories of Personal Data Personal Data concerned, c) the Recipients or categories of Recipients to whom the Personal Data has been or will be disclosed d) where possible, the envisaged period for which the Personal Data will be stored or if not possible, the criteria used to determine that period e) the existence of the right to request from the Bank rectification or erasure of Personal Data or restriction of Processing of Personal Data or to object to such Processing f) your right to lodge a complaint with the Commissioner of Data Protection g) where the Personal Data is not collected from you, any available information as to its source and h)the existence of automated decision-making, including Profiling referred to in sections 20 (1) and 20 (4) of the Data Protection Regulations 2021 and at least in those cases meaningful information about the logic involved, as well as the significance and the envisaged consequences of such Processing for you.

Banque Richelieu GCC Limited confirms your right to request the erasure of your Personal Data when (i) your Personal Data is no longer necessary in relation to the purposes for which it was collected or otherwise Processed or (ii) in case you withdraw your Consent on which the Processing is based and where there is no other legal ground for the Processing or (iii) in case you object to the Processing pursuant to section 19 (1) of the Data Protection Regulations 2021 or (iiii) the personal data has been unlawfully Processed or (iiiii) the personal data has to be erased for compliance with a legal obligation in applicable law to which the Bank is subject.

Banque Richelieu GCC Limited confirms your right to request the restriction of Processing when (i) you contest the accuracy of the Personal Data for a period enabling the Bank to verify the accuracy of the Personal Data or (ii) the Bank no longer needs the Personal Data for the purposes of the Processing, but it is required by you for the establishment, exercise or defense of legal claims or (iii) the Processing is unlawful and you oppose the erasure of the Personal data and request the restriction of its use instead or (iiii) you objected to Processing pursuant to section 19 (1) of the Data Protection Regulations 2021 pending the verification whether the legitimate grounds of the Bank override yours.

Banque Richelieu GCC Limited confirms your right to receive the Personal Data held by him in a structured, commonly used and machine-readable format and to object at any time, on grounds relating to the Processing of your Personal Data, and the Bank must not process the Personal Data unless he considers that i) there are legitimate grounds for the Processing which override the interests or rights of the Data Subject or ii) the Processing is necessary for the establishment, exercise or defense of legal claims.

Banque Richelieu GCC Limited will inform you if your Personal Data is transferred outside Abu Dhabi Global Market or to an International Organization of the appropriate safeguards pursuant to section 41 of the Data Protection Regulations 2021.

Banque Richelieu GCC Limited confirms your right to withdraw your Consent at any time. The withdrawal of Consent will not affect the lawfulness of Processing based on Consent before its withdrawal.

Complaints

If you have any complaints regarding the Bank Services, please use the form provided in this Site. You can fill in the form online using the Contact us form or submit it electronically by e-mail. The complaint will be taken in charge by the concerned party at the Bank. You shall get a confirmation/acknowledgment of receipt within seven working days of the complaint deposit and a follow up and update on the resolution of the complaint if the latter would need more than 30 days to finalize. The complaints should normally be closed within sixty days. In case of exception, you will be notified with the extra needed delays.

Termination

Banque Richelieu GCC Limited may in its discretion terminate this agreement, the Site, any part of it, or your access and use to it at any time.

Governing Law

These Terms and Conditions are governed by the laws of the ADGM. Any dispute or claim arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the ADGM courts.

The headings in these Terms and Conditions are for your convenience and reference only and shall not affect their interpretation.
